Terms and conditions
General Terms and Conditions for the rental of holiday apartments
1. Scope
These General Terms and Conditions apply to all contracts for the rental of holiday apartments concluded between the host (hereinafter “Landlord”) and the guest (hereinafter “Guest”) via the Landlord’s website or by any other means.
2. Conclusion of contract
(1) The presentation of the holiday apartments does not constitute a legally binding offer but an invitation to make a booking.
(2) By booking, the Guest submits a binding offer to conclude a contract.
(3) The rental contract is only concluded upon the Landlord’s written booking confirmation.
3. Arrival and departure / proof of identity
(1) The person who made the booking must be present in person on arrival.
(2) The Landlord is entitled to request a valid official photo ID (identity card or passport) on arrival for identity verification.
(3) Handing over the holiday apartment to third parties or its use by unregistered persons is prohibited unless the Landlord has expressly agreed.
4. Rent and payment terms
(1) The total rent agreed at the time of booking applies.
(2) The rent must be paid in full by the agreed date at the latest.
(3) In the event of late payment, the Landlord is entitled to withdraw from the contract and claim damages.
5. Cancellation and withdrawal by the Guest
(1) Free cancellation is possible up to 30 days before the agreed arrival date.
(2) In the event of cancellation less than 30 days before arrival or no-show, the full rent is payable.
(3) The Guest retains the right to prove that the Landlord has suffered no loss or a lower loss.
6. Liability of the Guest
(1) The Guest is fully liable for all damage caused by themselves, fellow travellers or visitors to the holiday apartment, its furnishings or shared facilities.
(2) Damage must be reported to the Landlord immediately.
(3) The Guest is also liable for consequential damage and for costs arising from necessary replacement or repair.
7. House rules / obligations of conduct
(1) The Guest undertakes to use the holiday apartment considerately and properly.
(2) Disturbances of the peace, material breaches of contract, damage, unauthorised overcrowding or other inappropriate actions entitle the Landlord to exercise their domiciliary rights.
(3) In such cases, the Landlord is entitled to order the guests to leave the holiday apartment immediately.
(4) In this case there is no entitlement to a refund of the rent.
8. Liability of the Landlord
(1) The Landlord is only liable for damage resulting from an intentional or grossly negligent breach of duty.
(2) For slight negligence, the Landlord is only liable for breach of essential contractual obligations (cardinal obligations), limited to foreseeable damage typical for the contract.
(3) Liability for injury to life, body or health remains unaffected.
9. Force majeure
If the rental contract cannot be fulfilled due to force majeure (e.g. natural disasters, official orders), both parties are released from their obligations. No further claims exist.
10. Place of jurisdiction and applicable law
(1) The law of the Federal Republic of Germany applies exclusively.
(2) The place of jurisdiction is Ravensburg, insofar as the Guest is a merchant or a legal entity under public law or has no general place of jurisdiction in Germany.
11. Severability clause
Should individual provisions of these terms be or become invalid in whole or in part, the validity of the remaining provisions remains unaffected.
